National Guard troops have been spotted standing near ballot drop boxes around the District, potentially in violation of federal election laws, a Howard University law professor said.

Federal law states that troops and federal agents can only be stationed near polling places to repel armed enemies of the U.S., but Justin Hansford, a professor at the Howard University School of Law, said he thinks there are instances where it’s veering into voter intimidation.
“There’s no real reason to think that the polls are under attack and need to be guarded, but their presence would intimidate voters, and so that’s clearly illegal,” Hansford told WTOP.
Even if there were reasons to fear an attack, federal troops would not automatically be called in, he said.
“You would have to see some type of widespread disruption and real legitimate threat of insurrection or something of that nature, and we’re nowhere near close to that,” Hansford said.
In a statement to WTOP, a spokesperson for the joint task force overseeing guard members stationed in the District said it is aware of “imagery circulating online of service members standing by a ballot drop box.”
“Maintaining public trust is a top priority, and JTF-DC service members are directed not to monitor or secure polling locations,” the spokesperson said. “JTF-DC is actively addressing this specific instance and remains fully committed to conducting its missions professionally, lawfully, and with respect for the public’s constitutional rights.”
“I do take some small slice of solace in the fact that they did respond and at least make it clear that they are not intending to be at the polling place,” Hansford said. “That’s a good sign.”
If residents see National Guard members near ballot boxes, Hansford encouraged them to take a photo.

“They should 100% take a picture. They should 100% post that picture,” he said. “Even if it doesn’t seem like there’s going to be any swift response today, we are hopeful that pretty soon that there will be people in place that will take this seriously, and we have seen the military respond recently to those pictures being posted.”
