The Court will not be weighing in on the law itself, but on the question of who is allowed to file a lawsuit over such policies.
Republican Rep. Mike Bost filed the suit, arguing that the law allowing ballots to be counted after Election Day, so long as they are postmarked by the deadline, is an illegal extension of voting.
Lower courts threw out the case, ruling that Bost did not have standing to bring the lawsuit because he was not specifically harmed.
Bost argued that campaigns suffer financial harm because they must staff their campaigns past Election Day while waiting for final results to be tallied.
The Illinois Board of Elections argued that his claim is too speculative and that allowing him to file the lawsuit would open the door for frivolous lawsuits over election rules.
President Donald Trump has supported the challenge to mail-in ballots, something he has long sought to eliminate.
If Bost prevails, it could revive the lawsuit in Illinois and spark similar cases in other states.
