The University of Maryland is threatening legal action against a company that produces cannabis products in Colorado. It is in relation to the company’s name “Terps USA.”

“We’ve been in business for seven years under the name Terps USA. We have a registered trademark Terps USA, and now we’re being asked to surrender our trademark,” said Ken Fry, the owner of the Colorado-based company that sells Terpenes, which enhances the flavor and aroma of marijuana.
He received a cease-and-desist letter from the University of Maryland on July 24, demanding they abandon the name, citing particular concerns that consumers may incorrectly believe that the university has licensed, sponsored, endorsed the products.
The letter sent by Janet Benson Forville, the university’s senior associate general counsel, said, “the University’s TERPS marks are a very valuable asset of the University and the State of Maryland. TERPS, along with the University’s other marks, is associated with and represents tremendous goodwill locally, nationally and internationally. Accordingly, the University demands that you cease and desist from all further use of Terps USA.”
Forville wrote if the matter was not resolved within 30 days litigation counsel, “is poised to take remedial actions.”
“I don’t know how a business goes about changing their name, changing their branding, and becoming a completely different entity in 30 days,” Fry told WTOP.
In a response to the university, Fry’s lawyer wrote that the university allowed the federal registration for the word over the last three years to lapse. According to the U.S. Patent and Trademark Office, the university filed for a Terps trademark in June.
“We’re open to having a conversation. We’re solution-oriented. We don’t want to fight with the University of Maryland. We don’t want to cause anybody any problems. We want to sell terpenes,” Fry said.
