It may soon become clear who will take the helm of the National Asset Recovery and Asset Protection Office (NVVH), which has been dubbed the “new Stasi” in reference to the notorious East German secret police. Three well-known organizations will assist TISZA officials in making a decision, Magyar Nemzet reported.
The chair of the Parliament’s Justice Committee, István Hantosi (TISZA) shared the schedule on Sunday, noting that the selection process will reach its most critical phase this week after the applications received for the positions of chair and vice chair of the National Asset Recovery and Asset Protection Office (NVVH) have been evaluated. On Monday, he announced that only three candidates—Miklós Ligeti, Anna Róza Unger, and Dávid Jancsics—remain in the running for the presidency of the NVVH.
The finalists come from diverse professional backgrounds. Miklós Ligeti is a lawyer and the legal director of Transparency International Hungary, a self-declared “anti-corruption” organization linked to the Soros network. Anna Róza Unger is a political scientist and associate professor at the Faculty of Social Sciences at Eötvös Loránd University. Her research focuses on direct democracy, electoral systems, and political financing. In recent years, she has also contributed to programs on the Radio Free Europe/Radio Liberty, a liberal-leaning international broadcaster, and the radical left-leaning Partizán. Dávid Jancsics is a sociologist and “corruption researcher” who lives and works in the United States, he is currently a professor at San Diego State University.
“To ensure genuine public oversight and professional safeguards, we consider the involvement of civil society to be crucial. The invited civil society organizations directly help us make the best possible decision through their expertise, independent perspectives, and professional knowledge, and their presence ensures the highest level of transparency toward the public,” Hantosi explained. He then revealed which three civil society organizations will consult with them prior to the selection process: the Hungarian Civil Liberties Union (TASZ), the Hungarian Helsinki Committee, and the nonprofit organization K-Monitor.
All three are strongly left-leaning NGOs with diverse ties to the Soros network, known for their long track-record of attacking the previous conservative government of Viktor Orbán.
Hantosi also emphasized that Prime Minister Péter Magyar will not have the right to veto the selection process.
The FIDESZ parliamentary group had previously announced that it would not participate in the nomination and selection of NVVH leaders because it considers the regulations governing the agency to be unconstitutional in several respects. Gábor Szűcs, a FIDESZ member of parliament, also reaffirmed the party’s position in a Facebook post on Monday.
He stated that FIDESZ will appeal to the Constitutional Court regarding the “the secret police law,” since “the entire organization is merely a tool of Péter Magyar’s autocracy,” whose goal is to settle political scores with his opponents.
The main criticism of the National Asset Recovery and Asset Protection Office is that this would create a “super-agency” unprecedented in the Hungarian legal system.
Since the agency is to be granted hybrid powers—combining administrative, investigative, and prosecutorial (prosecutor’s office) authorities—the proposal is facing sharp criticism from multiple quarters.
János Bóka, the FIDESZ parliamentary group leader, had particularly harsh words. “If you think you can turn to another authority to challenge the arbitrariness or abuses of the National Asset Recovery and Asset Protection Office, you are sorely mistaken. The agency can take over any proceeding at any time, and there is no legal remedy against this decision,” the politician warned.
János Bóka drew a historical comparison to the notorious communist state security agency, the ÁVH. Even that agency, he said, did not possess “as much power on paper” as is now being granted to the new agency.
Since this is not formally a classic administrative proceeding, those affected have neither the right to an attorney nor to general judicial protection,
said the FIDESZ politician.
Legal experts and constitutional analysts also expressed concerns regarding the rule of law. The broad, horizontal powers of the agency were particularly criticized. The fact that the agency may, in certain cases, replace the regular public prosecutor’s office and bring charges independently undermines the principle of the separation of powers and violates the public prosecutor’s traditional monopoly on prosecution.
