Everything you need to know about proposed changes to Chicago’s despised parking meters deal

A driver pays for parking on ParkChicago’s pay station on North Clark Street in Andersonville earlier this month.

The City Council is facing a Sept. 30 deadline to either approve New York investment firm Stonepeak Partners' $2.53 billion bid to acquire Chicago parking meters, or roll the dice in arbitration and in court.

Before casting that controversial vote, City Council leaders have brokered a compromise to try to level the playing field for Chicago taxpayers. What changes did they make? Why is the parking meters deal so controversial? Here's what you need to know:

What was so bad about the 2008 parking meters deal?

In 2008, then-Mayor Richard M. Daley leased the city’s 36,000 parking meters for 75 years to a private investment consortium for $1.15 billion. He used those proceeds to avoid raising property taxes at a time when city employee pension funds were sinking deeper in the hole.

The lopsided deal sold off an asset that was generating revenue for the city. Motorists paid the price with steep rate hikes. The Chicago Parking Meters LLC consortium formed by Morgan Stanley, Allianz and Sovereign Wealth recouped their initial $1.15 billion investment by 2019 — roughly 11 years into the 75-year lease.

Steep rate increases built into the deal would have been bad enough. Rates downtown, for example, rose from $3 an hour in 2008 to $6.50 an hour in 2013. But broken and frozen pay-and-display boxes, along with overstuffed and improperly calibrated meters that overcharged motorists, made it even worse.

Some motorists were so incensed they vandalized meters and boycotted metered parking, leading to a dramatic drop in on-street parking.

The deal also required the city to compensate Chicago Parking Meters LLC for every parking space taken out of service, either for a special event or construction project. That part of the deal alone has tied the city’s hands and cost Chicago taxpayers tens of millions of dollars.

Daley muscled the deal through the City Council with only five dissenting votes and little debate.

With no direction from the mayor, Finance Chair Pat Dowell (3rd) said she and other other veteran alderpersons “took the bull by the horns and did the work” to try and, as she put it, “make lemonade out of lemons.” They negotiated an agreement that calls for the city to receive a $75 million transfer fee at closing and 5% of net income going forward — or $376.2 million over the course of the agreement.

It also would reduce costly compensation the city is required to pay for every space taken out of service.

Stonepeak has also agreed to sell Omni Air International, an airline that has provided long-haul deportation flights for the Department of Homeland Security during President Donald Trump’s deportation campaign. And it has agreed to explore creating entire non-metered city blocks as “potential electric vehicle charging stations with charging revenues shared with the city.”

The $75 million up-front payment and offer of future profit-sharing may not be enough to garner the 26 votes needed for passage.

With aldermanic elections less than five months away, some alderpersons may want to push the envelope to see if they get some kind of a break for motorists.

“City Council members who we’ve been in contact with are still talking. They might be looking at certain points saying, `Hey maybe can we sweeten here, sweeten there?’“ senior mayoral adviser Jason Lee told the Sun-Times. “But in general, the idea that, if you’re going to approve that … you’re going to get concessions that are better for the taxpayers — obviously that is something that we believe is the right direction.”

What happens if the Council does not approve the compromise deal?

The risk to Chicago taxpayers is great. It could cost the city millions.

The Morgan Stanley-led investment group could first ask an independent arbitrator to order the City Council to approve the sale or pay an exorbitant penalty, then file a lawsuit.

Former U.S. Attorney Dan Webb, who represents the investment group, wrote a letter to the mayor in June warning the city could face “financial catastrophe” if the sale to Stonepeak Partners is rejected.

“If the city breaches” the 75-year lease “with the result that the sale to Stonepeak collapses, that will destroy value measures in the billions of dollars for which the city will be held legally responsible,” Webb wrote in the letter.

Is that an idle threat?

No, it isn’t. Last year, Chicago taxpayers were forced to spend $15.5 million to compensate the investment team that leased the meters, thanks to a risky pandemic-era scheme authorized by former Mayor Lori Lightfoot. As bitter a pill as that was for Chicagoans who despise the deal, it could have been a whole lot worse. The investment group started out by seeking $322 million from the city. An arbitrator recommended $120.7 million. The fact that the Johnson administration managed to persuade Chicago Parking Meters LLC to accept $15.5 million — just 12.8 % of the original demand — was a victory, even though it didn’t seem like it.
