Hungary will initiate European court proceedings seeking the annulment of the REPowerEU regulation, that was adopted “through legal fraud” with the aim of making Russian energy imports impossible, Foreign Minister Péter Szijjártó announced on Monday.
The minister emphasized that the ban on the purchase of Russian crude oil and natural gas is sharply contrary to Hungary’s interests. “If we cannot purchase crude oil and natural gas from Russia, it means that families’ energy bills could triple, and factories could also find themselves in a difficult situation due to price increases,” he warned.
“For this reason, as soon as this decision is officially published, the Hungarian government will file a lawsuit with the European Court of Justice, seeking to have this legislation repealed by the European Court of Justice,” he confirmed.
This legislation was created through a huge legal fraud, as its content is a sanction that would have required a unanimous decision. However, in order to avoid opposition from sovereign national governments, this decision was fraudulently disguised as a trade measure, therefore a qualified majority was sufficient,”
he explained.
Hungary will take legal action before the Court of Justice of the EU as soon as the decision on REPowerEU is officially published. We will use every legal means to have it annulled.

Minister Szijjártó emphasized that this decision is also completely contrary to the European Union’s own legislation, as the basic treaty clearly states that it is within the competence of the nations themselves to decide what energy sources they purchase and from where.

On Monday, January 26, the Council of the European Union adopted the REPowerEU regulation that will gradually phase out Russian gas in the EU by the end of 2027. In the vote, 24 of the 27 state secretaries and ministers representing the member states voted in favor, while Hungary and Slovakia voted against and Bulgaria abstained.
With the adoption of the regulation, imports of both pipeline gas and liquified natural gas (LNG) transported via Russia into the EU will be prohibited. The ban will take effect six weeks after the regulation enters into force, while existing contracts will be subject to a transitional period. The total ban will apply to LNG imports from the beginning of 2027 and to gas transported via pipelines from the fall of 2027.
Failure to comply with the new rules may result in fines of up to €2.5 million for individuals and up to €40 million for companies, or at least 3.5% of the company’s total worldwide annual turnover or 300% of the estimated transaction turnover.
EU member states must draw up national plans by March 1, 2026, to diversify gas supplies and identify potential challenges related to replacing Russian gas.
Barna Pál Zsigmond, Parliamentary State Secretary of the Ministry of European Affairs, has previously stated that the regulation is “flawed” in several respects. He explained that determining the energy mix would be a matter for national governments, but even if it were considered a matter for the EU, it would still involve a sanctions regime, which would require unanimity. However, he said,
this had been reclassified as a trade policy issue through a “legal trick,” making it acceptable even by majority decision.

The state secretary noted that all this violates the principle of solidarity and fundamentally undermines Hungary’s energy security, yet they want to force it on the country, that must be prevented. He believed that it also violates the EU’s competitiveness goals, as high energy prices have caused Europe to fall behind in the global competitiveness race.
