The federal agency that enforces workplace discrimination laws is suing MedStar Health, accusing the hospital system of withdrawing a job offer after learning that a man with a disability received medication through an IV in Maryland.
The U.S. Equal Employment Opportunity Commission said MedStar Southern Maryland Hospital Center in Clinton also told the man he would have to stop the IV treatment before he could start working.
According to the EEOC, MedStar offered him a job in hospital admissions in March 2024. He accepted the position, and before he could start, the hospital required him to undergo medical evaluations and answer questions about his health.
The EEOC said that process uncovered his disability and ongoing IV treatment.
After learning about his condition, MedStar would not clear him to start the job, according to the agency. The EEOC said he was then told that if he wanted to keep the position, he would have to stop the IV treatment.
The agency also said MedStar denied him a reasonable accommodation before withdrawing the job offer and ultimately refused to hire him.
The lawsuit accuses MedStar Health and MedStar Southern Maryland Hospital Center of violating the Americans with Disabilities Act.
“The Americans with Disabilities Act prohibits employers from making hiring decisions based on stereotypes or fears of a disability,” EEOC Regional Attorney Debra M. Lawrence said in announcing the lawsuit.
The EEOC said it went to court after efforts to resolve the dispute failed.
In response to WTOP’s request for comment, MedStar Health said it “can not comment on pending litigation.”
The allegations have not been decided by a court.
